1. Who you're contracting with

The Rooted app ("Rooted", "we", "us") is operated by evolveapp ("the seller"). By using Rooted you enter into an agreement with evolveapp.

2. Acceptance

By creating an account, starting a trial, or otherwise using Rooted, you confirm you have read, understood, and accepted these Terms. If you do not agree, please do not use the service. You confirm you are of legal age in your jurisdiction or have authority to bind the organisation on whose behalf you act.

3. The service

Rooted is an AI-assisted habits, mentor, and growth-tracking application. We grant you a limited, non-exclusive, non-transferable right to use Rooted within the plan you've selected.

4. Acceptable use

You agree not to: (a) use Rooted unlawfully or fraudulently; (b) send spam, malware, or other harmful code; (c) infringe anyone's intellectual property; (d) probe, scan, scrape, or otherwise interfere with the security or integrity of the service; (e) attempt to reverse-engineer or resell the service; or (f) use Rooted's AI mentors to generate illegal, deceptive, harassing, or harmful content. You are responsible for the content of your prompts and for verifying the accuracy of AI outputs — Rooted's mentor responses are guidance, not professional medical, legal, financial, or psychological advice.

5. AI outputs

AI-generated content may be inaccurate, incomplete, or out of date. Do not rely on it for regulated professional advice without independent human oversight. You retain responsibility for actions you take based on AI outputs.

6. Your account

You must provide accurate information, keep your credentials confidential, and are responsible for activity under your account. You grant evolveapp a limited licence to host and process the content you submit solely to provide the service to you.

7. Intellectual property

evolveapp retains all rights, title, and interest in the Rooted software, branding, content, and documentation. No rights are granted to you except as expressly stated in these Terms.

8. Payments, billing, and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment terms, billing cycles, taxes, automatic renewal, cancellation, and refunds are governed by Paddle's Buyer Terms, together with our Refund Policy. Subscriptions renew automatically at the end of each billing period until cancelled.

9. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated/serious policy violations. On termination, your right to use the service ends; you may request export of your account data for a reasonable period before deletion.

10. Service level and warranties

The service is provided "as is". We don't guarantee uninterrupted or error-free operation. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

11. Liability

To the fullest extent permitted by law, our aggregate liability arising out of or in connection with the service is capped at the fees you paid in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, consequential, or special damages including loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence where it cannot be limited by law.

12. Indemnity

You agree to indemnify evolveapp against third-party claims arising from your content, your unlawful use of the service, or your breach of these Terms.

13. Changes

We may update these Terms from time to time. Material changes will be notified in-app or by email. Continued use after changes constitutes acceptance.

14. Governing law

These Terms are governed by the laws of England and Wales, and disputes are subject to the exclusive jurisdiction of its courts, unless mandatory local law in your jurisdiction provides otherwise.
